What if the case is where I want to take up a new full time position and convert my current full time position to part time.....I guess one way to do it would be to transfer H1 to the new employer...wait for an approval and then file for another concurrent H1 for the part time job with the old company..But the problem is I'd have to wait until new approval comes...and also convince both companies to shell out 2k plus in filing fees....does any one have a better alternative ? I have a question regarding I-485 finger prints. Can I goto local USCIS office for fingerprints without original FP notice. I have a copy of the FP receipt notice sent by my lawyer by e-mail.

If u have not recieved ur original fp notice and if lawyer recieved the courtesy copy of ur fp notice,u can take that print and attend ur fp appointment as scheduled.I did not recieve my fp notice by mail,but went and attended successfully my fp appointment with lawyer's copy.Just take passport and ur driver's license for photo identity.(passport only for safe side).

I think it would be better idea to call them and find out their hours of operation. The address is usually given on the FP notice letter.

Great news for EB2 India.
As expected, this will clear out early 2006 cases.
Also note that now EB2 India and China has same PD and that means EB2 China may consume some of the spillover (or fall down/across) numbers.

"Oversight" is correct as Visa Office was responding to House Committee that has oversight function for immigration.
I'm guessing you meant "insight" (understanding, revelation) not "oversight" (supervision, mistake)

Hello Mates & Buddies,
I am currently holding Indian Citizenship and planning to file my H1 on Indian passport.
But at this year end I am also planning to take my Australian Citizenship.
So could anyone please suggest or share his experience whether transferring H1 on totally new citizenship is possible or not ? if yes then what's the way ?
And does anyone has any experience or knowledge of E3 (Australian Work visa to USA).

Yes one must be a Greencard holder to attain unemployment benifits.

This is not true. People in AOS can apply for unemployment benefits. Unemployment benefits are paid by employers and all you need is an A number to get it.

Hi Sir,
I have a question regarding H1B transfer and should I go premium processing or not?
Here is my case:
I was laid of from Company A (not consulting) last week. I have all my past pay stubs. That was total shock to me and got me off-guard.. It took me few days to find a consulting company B which is willing to transfer my H1B.
As any big company, A is quite prompt in sending revoke letter so I would assume they would be already doing it by now. Company B will be sending transfer papers tomorrow(Friday) or Monday.
My question is should I go with Premium Processing or not? I just dont want to take any risk where USCIS denies my case. Is premium processing going to help me here or not.

It depends on job duties mentioned in the LCA. For example, you might be a solution architect and this comes with experience. Some roles could be guiding junior folks, interviewing people, reviewing work done by others, project management, vendor management etc ... Essentially you need to prove your 5-year experience is worth and that is what is needed to fill your current role. Prove that this can not filled by a plain BS graduate with no experience or even a guy/girl with MS degree and no experience. DOL might be thinking why not just a BS degree or BS + 5 years = MS degree.

Actually I had an H1 visa 2 years back and when I had my baby I quit my job and my H1 was cancelled by my company. Now I am on H4 and want to work again. But no company is doing H1 these days without a job offer in your hands and even if I get a job offer no client company is willing to wait for a long time for my H1 approval. So, I wanted to check my options with premium processing. How long does it take if I go for premium processing of H1 visa ?
