Our visa stamp (H1B/H4) are expired in our passports. We are planning to travel via 'Frankfurt (FRA), Germany' to Mumbai in Lufthansa airlines and we will get our passport stamped in Mumbai. Does anyone have experience travelling via 'Frankfurt (FRA), Germany' without visa stamp in passport?
I know that travlling via London has some difficulties but not sure about 'Frankfurt'.
Please let me know.
FYI..We have our EAD and I-485 is pending with approved I-140.

You should not have any issues travelling via Frankfurt to India with an expired visa stamp. I've travelled as recently as last month with an expired visa stamp.Returning to the US with a visa stamp or using advanced parole should be fine.
I know that travlling via London has some difficulties but not sure about 'Frankfurt'.

Infact I got a call from US Consulate and they said the same thing to me, and they offered to cancel the appointment for me.
I did get the appointment thru some agency and was wondering if they played a trick but the agency vehemently denied doing any such thing,
I had a Toronto appt as well.
However not sure if it was an official call or a prank
I have an appointment in Toronto next month and today I got a voice message from the US embassy in Canada saying that there could be processing delays of days or months and the decision will be taken by the visa office during the interview. Has anyone else got this kind of message?

:confused:Here is another scenario -
485 filed 1 year back and have been working with the GC sponsoring employer since then ( on H1, did not use EAD).
Employer is not going to revoke approved I-140 even if i change Job/H1.
Now, can i use Advance Parole to travel while working for the new employer on a new H1?

Hi,
I have been on h1 for 7 yrs in the US and i am leaving back to my home country (India) as it is expiring this month. I plan to come back and start working for my current company next yr.
Now can they Process my new H1 in April next yr(6 months from now) or they have to wait till OCT 2007 to process my new h1. I am afraid the next yr quota will be over if they have to wait till OCT.
Here is what you could do:
1. Get a good immigration attorney
2. Recoup all the lost time on H1-B for time spent abroad in the last 7 years. Most attorneys can recover at least 4-6 months of time - this will alllow you to stay in the US for another 4-6 months
3. Use the time to find a substitute labor (either with present or new company) and file for I-140. Use premium processing for I-140.
4. Your Labor sub and I-140 should clear within the timeframe that you remain in the US - and then you can renew your H1-B for 3 year increments.
The reason i give the above solution is that - your New H1-B will only be valid after Oct 2007 - you can apply for it in April 2007 but you cannot use it until Oct. If you are really keen to stay in India for that long then obviously its ok, but you need to be sure your company will still remember you in Oct 2007 - otherwise i would suggest the alternative approach above to remain in the US.

Hi,
I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

I was sarcastic, if you didn't get it. INS/government always had monopoly over giving out of GCs(the constitution guarantees it for them). They never had competition about it. You're kidding yourself to think that you can sue them on anti-trust laws. Some other laws may be but definitely not anti-trust laws.

My date will be current from September 1st. Is it okay to travel to India on a short trip while the date is current? If 485 gets approved while I am india, can I still come back on advance parole?
You are safe. Just make sure that your AP is valid when you re-enter.
If you are approved while out of the country, take a print out of your approval email and show it to the Immigration officer.

clif, I wouldn't worry too much regarding the interview. Just take the latest paystubs, Employment letter from your new employer and all the evidence that you have to prove that you have been legally maintaining status in the country. Since you have already submitted medical exam results you don't need to take them with you.
They usually just send a standard letter without checking any items in the list.

Did he/she send the original Employment letter? What is the PD of your friend?
From what I understood his lawyer did not send the employment letter in the first place. His priority date is Sep 04 ROW, mine is July 04 ROW.

My employer is a small consulting company,which don't have own projects.So they pay only when I get project with other consultancies companies and bill through them.
You get work visa in canada then you need to be paid in canada..Work visa in canada has nothing to do with that of US status.
If you are getting paid in usa ( it seems like) and planning on working in canada on visitor visa its not legal. This might be the reason.
Your status in US has nothing to do with Working/Visiting/studying in Canada.
If you have used AP you "Probably" not on H1 any more.. there are some contradicting statements of IV members on this before. But I have seen USCIS sending a notice for one of my friend where in which he was advised to use AP ( as he is considered being on AOS eventhough he has H1) in future.

If he marry a US citizen, she can file his I-130 eventhough he is out of status.
(If the entry into USA is legal and out of status later, can adjust, if filed by spouse)
For parent , brother/sister filing, I don't know and I don't think it is possible.

My brother got a B1/B2 multi-entry visa for 2 years. My mother is a green card holder and my brother didn't want her to submit an I-130 on his behalf since she became a US resident. The reason was because one of the questions that the embassy asks when you apply to get a visa to enter the US is weather a relative submitted an I-130 on your behalf or not. If yes then the embassy thinks of you as you want to enter the US and remain there until ur I-130 is approved and a visa number is available.. my question is since my borther got his visa, will it be ok for my mother to submit an I-130 on his behalf now without having the embassy rejecting him B1/B2 visa in the future(that is after his current B1/B2 visa expire in 2 years ????
