Just wondering if anybody is giving up hopes of GC and switching from H1B to E3D (Dependent of Australian spouse) to take advantage of 2-yr renewable EADs...? How long does it take to get the initial EAD...Continue working without pay (or is there a workaround) while waiting for EAD?....any problems getting visa stamped with a 'yes' for past immigrant petition filed...
7yrs in this country...EB2 PD of 10/07 due to job changes..no 140 yet, no 485...6yrs in same job? no promotions? with 3yr extensions...frustration beyond words...E3D seems to a ray of hope but no idea of complications involved.
My cousin (unmarried) is on an E-3 visa. But if I remember correctly, an E-3 visa holder cannot have immigrant intent. So the "immigration petition filed" question might create trouble. You should consult a lawyer.

Just want to share the info that i got from my immigration firm news letter
Under Section 265 of the Immigration and Nationality Act (INA), all non-U.S. citizens who change their residential address are required to notify the U.S. Citizenship and Immigration Services (USCIS) within 10 days of the change. This applies to all adults and children (of any age) who are non-U.S. citizens, including U.S. green card holders.
A person who fails to notify the USCIS of a change of address within 10 days of the change is guilty of a misdemeanor under Section 266 of the INA. The penalty for failing to notify the government of the new address within 10 days is a fine of up to $200.00 or possible imprisonment for a period not to exceed 30 days, or both. If you have a receipt as proof that an extension application was filed on your behalf before expiration of your H1 then you have 240 days starting from the day your visa expires before you should get an extension. You will be out of status if your case is not resolved in the 240 days deadline. I cannot comment on the implications of missing out on a deadline for responding to the RFE.

Her petetion is filed in May. And she travelled out of USA last month. So you need to do is to start working and get a visa stamp of H1 when you go out of the country.

Check out data for China. It shows significant reduction from last month. Expectations are low for India but China will advance a lot in July.
If spillover kicks in (& it should in July) then both China and India will have to move together (exact same cutoff date, because the law says spillover visa's are to be used evenly by those in the same category. USCIS has been doing horizontal spillover, so all EB2's will be equally eligible and have the same cutoff.

The tax returns for FY2002, 3 (accepted/filed) can show the Nett Equity of the company - that should be greater than the (total) difference between the PW and actual salary

I am working under CPT from a university. I am not planning to continue school if i get h1b. My last day to register for classes is Oct 10th. My h1b case in USCIS website days it is received and pending. I filed for premium processing on Sept 23rd, application reached to USCIS on 24th. It will be 15 calender days on Oct 9th. In this case can i work without registering at school after OCT 10th?
I will really appreciate any suggestions.

In my opinion, one of the more intriguing product announcements from Nikon today was the Coolpix 8700. If it improves significantly from the Sony, that could be a killer product. Right now, Canon is lacking a bit in the true consumer DSLR market. But then again, PMA is right around the corner. The Sony has Zeiss glass and 28mm WA. But the CA and Noise are horrible. Isn't the Nikon 8700 has same sensor size as the Sony 828? Wait and see how the Nikon performs in those deaprtments!

No, Expression Blend cannot be used to create content for mobile devices. Blend only creates WPF and Silverlight applications - both of which do not run in a mobile device :)

URGENT HELP
Its a simple case. I read all the posts on this thread but I dont think I got an answer I want. Here is my dilemma -
Scenario: I currently work for Company A. I interviewed with Company B and they are ready to file for my H1b transfer but they need me to join within the next 3 weeks. Today is Feb 6th 2008.
Question1) Is there anything like a H1Btransfer or is it a brand new application??
Question2) Does this H1B transfer go through the 65,000 quota system?? Is there a chance my H1B transfer can be rejected because I did not make it in the 65,000?
Question3) When can I start working for Company B?
Question4) Company B said that I should only inform Company A after I get a receipt from USCIS about my H1B transfer. If Company A matches up the salary what Company B is offering me after I inform them and I still havent started working with Company B, can I stay with Company A? If yes, What about the H1B transfer application by Company B?

A lot of people have filed on July 2 and still haven't received their FP notice while my husband and I filed July 6 and we're scheduled for FP tomorrow. My brother who filed on July 26 also received his FP notice last Friday. USCIS is really unpredictable nowadays so who knows how long it takes to generate FP notices. Hopefully you'll get yours soon too. :o

My 6 years of H1B expires next month (April 2009). My PERM labor was applied in Feb 2008 and got approved last week. My question is, can I apply for 7th year H1B extension based on the approved PERM (since it was filed more than 365 days ago)? Attorney says there is not enough time to file I-140 and get it approved (even with Premium processing) before my H1 runs out next month.
From my research online there are two options to extend H1 beyond 6 years:
- PERM pending for more than 365 days, or
- I140 approved
What about the scenario where PERM is filed more than 365 days ago and approved, but no I-140 yet?
Gurus I'd really appreciate your inputs here!!

I have done quite some research on this. Bottom line is you are taking major chance in loosing it unless one of the following applies.
1) You are married to Canadian citizen.
2) Your company is Canadian (or has office in Canada who can give letter that you are direct employee of a Canadian company working abroad).
Otherwise you are taking chance. The airlines etc will still let you board a plane etc to go there, and Canadian Govt is bound to let you in, but then you will have to fight a case against the cancellation of PR order and its a mess.
I would say decide one way or the other. I know its easie said than done.
If you are in EB3, than unless new laws are passed or something changes, you could go to Canada, live there 3 yrs, get Canadian citizenship and your PD will still be waiting for you at May 1st when you come back.
